Skils successfully represented Czech Railways in a dispute with a supplier of railway motor cars

The Skils law firm legally represented České dráhy, a.s. (Czech Railways) in a long-term dispute with the company Stadler Deutschland GmbH regarding the discount for defects in the ČD 840 series motor cars. In a judgment dated May 14, 2024, the Municipal Court in Prague decided definitively that ČD is entitled to the full amount of the requested discount for motor car defects. The Municipal Court in Prague, as an appellate court, so decided for the second time, when in the first case it returned the case, based on a successful appeal by ČD, back to the court of first instance with an instruction to reassess the amount of the discount originally granted to ČD in a lower amount. Based on the current judgment, Stadler is obligated to pay ČD the full amount of the sued amount, default interest and costs of legal representation, which in total amounts to approximately CZK 130 million.

In the proceedings, it was necessary to examine and expertly assess complex technical issues and apply appropriate legal argumentation. As a result, the dispute lasted approximately 9 years from the beginning to the issuance of this final judgment. Czech Railways has been represented by the Skils team throughout the whole proceedings.
