Victory in International Arbitration (ICC). Skils successfully defended former shareholders of the Fincentrum Group

Team of Skils represented Fincentrum Holdings (LUX) S.A., which brings together the private equity funds ARX Equity Partners and Capital Dynamics, former shareholders and founders of the Fincentrum consultancy group, against the claims of the Swiss company Swiss Life asserted in international arbitration under the rules of the International Chamber of Commerce in Paris (ICC).

As a claimant in arbitration, Swiss Life sought compensation for damages allegedly caused to it by the alleged unlawful conduct and breach of the guarantees given by the sellers during the sale of the Fincentrum Group to Swiss Life in 2018.

The arbitral tribunal dismissed all of Swiss Life’s claims in their entirety after conducting the proceedings and taking of evidence. In the arbitral award, it stated, among others, that neither the conduct alleged by the claimant nor the breach of warranties by the respondent had taken place. In addition, the Court ordered the claimant to compensate the respondent for all costs incurred by it in connection with the arbitration.
