Skils successfully represented Baby Direkt before the Regional Court in Brno in the matter of so-called vertical price fixing
On August 24, 2022, the Regional Court in Brno annulled in its entirety the decision of the Chairman of the Office for the Protection of Competition, by which a penalty of CZK 40,793,000 for alleged vertical price fixing was imposed on Baby Direkt. At the time of the issuance of the decision, this was the highest penalty in history imposed by the Office for the Protection of Competition for alleged conduct of this type. However, the Court upheld the action in the basic argument, which pointed out the unlawfulness of the Office’s decision. Specifically, the Court found that the Office erred in establishing the existence of the alleged prohibited agreements and also in the obligation to properly identify the alleged agreements. The Court thus found the Office’s decision unreviewable.
